CBD Oil in UK: Legality, Regulations and Restrictions

Cannabidiol, popularly known as CBD oil, has gained widespread popularity in the UK in the last few years. There are medical experts across the world who swear by the efficacy of this Cannabis-derived oil for addressing problems such as anxiety, pain relief, epilepsy, PTSD, insomnia and more.

In fact, it can now be commonly found in a wide range of products such as creams, sweets, vape liquids and even sexual lubricants. It might also surprise you that CBD oil already has a customer base of more than a million in the UK.

But is CBD oil legal in the UK? What are the regulations and restrictions?

Is CBD Oil Legal in the UK?

There is a lot of confusion about the legality of CBD oil in the UK, primarily because many of the cannabinoids are considered “controlled substances” as per the Misuse of Drugs Act.

For the unversed, cannabis plants are made from many different cannabinoids. These are chemical compounds that impact the cannabinoid cell receptors for altering the release of neurotransmitters in our brains. Cannabidiol, which is used for making CBD oil, is one such cannabinoid derived from cannabis.

But while several cannabinoids are “controlled substances” in the UK, cannabidiol or CBD oil is completely legal as long as it is derived from an EU-approved industrial hemp strain. It is also essential to note that any manufacturer or retailer in the UK should not make any claims with regard to the medical benefits of CBD.

What About CBD Oil Which Also Has THC?

THC (Tetrahydrocannabinol), another primary cannabinoid found in cannabis, is not legal in the UK. This also means that CBD oil, which has a THC content of above 0.2% in it, is not legal.

However, Sativex, a mixture of CBD and THC, is approved for the treatment of multiple sclerosis if it has been produced in a laboratory.

Can You Carry CBD While Travelling to the UK?

Yes, if you’re about to travel to the UK along with CBD oil in your bag, you can do so without worrying about any legal consequences. However, the CBD oil should meet the UK laws.

In other words, it should be a product created for consumption by humans and not contain any THC. You can carry your CBD oil in your hold luggage or hand luggage. But in hand carry, it should be stored in a container of not more than 100ml. Larger containers, even if they are partially filled, can only be carried as hold luggage.

You should also note that the air carrier you select for your flight can have its own regulations. Ensure that you consult with the airline before booking your flight tickets.

What About Carrying CBD Oil While Traveling from the UK?

If you want to travel with CBD oil from the UK to another country, you should try to find out the legal status of CBD oil in the country you’re traveling to. If the destination country also treats CBD oil as legal, there shouldn’t be any legal consequences. But do remember that even in countries that have given legal status to CBD oil, the regulations significantly vary.

If you want to travel to other EU nations, countries like Spain, France, Portugal, Belgium, Netherlands, Slovakia, Austria, Germany, Italy, Greece, Romania, and many others have regulations similar to the UK. So, if you want to travel to these countries with CBD oil from the UK, there shouldn’t be an issue.

Can You Carry CBD Oil from the UK to the US?

If your CBD oil meets the regulations in the UK, it should very well be allowed in the UK too. But the regulations vary between US states.  Before your departure, ensure that the THC content in the CDB oil, if any, is less than 0.3%. Confirm that the CBD oil bottle clearly states the amount of THC.

Also, you can only carry an unopened and sealed bottle of CBD oil. So, if the bottled is not sealed or open, it will mostly be confiscated at every US airport.
